Today, I have a very boring email for you (It’s the truth 🤪)—but a very important one—because not following rules and regulations can have serious consequences for you and your business.

In the U.S., advertising compliance is governed by the FTC (Federal Trade Commission). If you’re outside the U.S., find out which organization oversees advertising in your country and follow their rules.

Why does this matter? Recently on TikTok, a brand was exposed for claiming their products were made with materials A and B. Not only was this false—one of those materials was highly flammable. An influencer dug deeper and uncovered even more misleading claims from the brand’s website. All of it could have been avoided with accurate disclosure.

Here’s the thing—fancy marketing words might seem harmless, but your reputation is on the line. Don’t risk your livelihood just to sound more impressive.

Every ad, every email should comply with the FTC (or your country’s equivalent). That includes avoiding phrases like “fast shipping” or “guaranteed results” unless you have a clear plan to honor those promises.

Misleading practices can spread like wildfire—especially when advertising puts you in front of thousands of people. And it happens more often during rapid growth.

How to remain compliant

Here’s a practical, no-fluff list of things businesses should always remain compliant with—whether you’re running ads, sending emails, or simply selling online. Please feel free to reply to this email if you have any questions, I know it’s a lot.

Advertising & Marketing Compliance

  1. Truth in Advertising – All claims (product features, benefits, materials, results) must be accurate and not misleading.

  2. Substantiated Claims – Be able to back up any promises (e.g., “guaranteed results” or “clinically proven”) with real evidence.

  3. Accurate Pricing – Clearly display full prices, including taxes, fees, and shipping, without hidden charges.

  4. Transparency in Promotions – Disclose limitations, expiration dates, or eligibility requirements for discounts and offers.

  5. Authentic Reviews & Testimonials – Only use genuine customer feedback; disclose if reviews are incentivized.

  6. Influencer & Affiliate Disclosures – Influencers, affiliates, or partners must clearly disclose paid partnerships (FTC requires #ad, #sponsored, etc.).

  7. No False Urgency – Avoid fake countdown timers or “only 2 left” claims unless they’re true.

  8. Honest Shipping Claims – If you say “fast shipping” or “ships in 24 hours,” ensure it’s consistently accurate.

  9. Pre-Orders: If you’re shipping inventory that isn’t available yet, let your audience know it’s on backorder or available for pre-order.

Privacy & Data Compliance

  1. Data Protection Laws – Comply with GDPR, CCPA, or local privacy laws for collecting, storing, and using customer data.

  2. Email Marketing Consent – Use opt-ins for email lists and honor unsubscribe requests promptly (CAN-SPAM, GDPR).

  3. Secure Payment Processing – Use PCI-compliant systems to protect customer payment data.

Product & Service Compliance

  1. Safety Standards – Follow all industry-specific safety and labeling requirements (especially for food, cosmetics, or children’s products).

  2. Proper Material & Origin Labeling – Be transparent about where products are made and what they’re made of.

  3. Refund & Return Policy Clarity – Clearly state return and refund policies before purchase; honor them without hidden obstacles or fees. Disclose on your website is there is a restocking fee.

  4. Accessibility Standards – Ensure websites and digital content are accessible to people with disabilities (ADA compliance in the U.S.). I use https://accessibe.com/ to remain compliant.
